A joint report prepared by LSC and Ofsted recently concluded that some providers have been undertaking measures to maximise success rates which are contrary to published guidance. Such artificial increase in success rates have also come to the attention of both the press and MPs with headlines appearing in the TES and questions being raised in Parliament.

Both the LSC and Ofsted have proposed new measures to identify such inappropriate practises as part of the audit and Inspection processes. Providers have been instructed to cease any such practices with immediate effect but it has also been suggested that evidence of wrong-doing in 2007-08 and/or 2008-09 may have a significant negative impact on future Inspection grades, particularly in respect of Leadership and Management.

As reported in the TES more recently, the Skills Funding Agency has threatened to ban some colleges and training providers from receiving public funding as allegations continue to be made that they are profiting from breaking the rules 'by ignorance or design'.
